On May 25, 2017, I shared updates concerning Canadian Anti-Spam Legislation (CASL) and important changes scheduled to come into effect on July 1, 2017. Since that date, in response to considerable pressure from various sources, the Federal government announced it would delay one of those changes – the “private right of action” available in the case of violations (see bullet #2 in PDAD&C #105). However, bullet #1 remains in effect. Consequently, in the rare occasions where your unit may consider sending a commercial electronic message relying on implied consent, I would ask that you seek further guidance from your Dean’s Office, which can consult with legal counsel as necessary.
